ARTICLE 2 - ACCEPTANCE OF THE TERMS OF USE

Any person connecting to the Site will be referred to hereinafter as the “User.”
The User, by accessing the Site and/or using the services offered by the Site, agrees to comply with these general terms of use (“the GTU”), which they declare and acknowledge having fully read.
The GTU govern the relationship between the Site and the User, with the Site being accessible from different devices (computer, tablet, smartphone, etc.). SPOA PROD may modify the GTU at any time and unilaterally. These modifications will be binding on the User as soon as they are posted online on the Site, which it is the User’s responsibility to regularly consult to become aware of them. The User is deemed to accept this latest version with each new connection to the Site.
In case of non-compliance by the User with the GTU, SPOA PROD may suspend without notice the services offered by the Site and/or deny access to said services.

It is specified that, in the relationship between SPOA PROD and the User, the GTU govern their entire contractual relationship and apply to the exclusion of any other agreement.

ARTICLE 3 – ACCESS TO THE SITE

The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure or an event beyond the control of SPOA PROD, subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Site and services.

ARTICLE 4 - DESCRIPTION OF SERVICES OFFERED BY THE SITE

The purpose of the Site is to present to Users the activities and achievements of SPOA PROD.

ARTICLE 5 - INTELLECTUAL PROPERTY

Content of the SiteAll the content on the Site (Videos, photographs, graphic design, mockups, texts, logos, brands, software, etc.) is protected by the Intellectual Property Code and cannot be reproduced, represented, adapted or used without the express and prior consent of SPOA PROD and/or the rights holders on said content. Any unauthorized use of said content will constitute an act of infringement liable to result in civil and/or criminal proceedings. 

ARTICLE 6 - PROTECTION OF PERSONAL DATA

The Site allows SPOA PROD to collect certain information concerning the User. This information is collected in accordance with the legislative and regulatory provisions in force relating to the protection of personal data and is intended to offer the User a personalized and optimal use of the Site.

Data collected

When the User visits the Site, the site traffic and the user's IP address may be collected, which remains anonymous.

Data processing manager

The personal data of Users are processed by SPOA PROD directly or through an IT service provider, in compliance with the provisions of the French Data Protection Act No. 78-17 of January 6, 1978, as amended by the law of August 6, 2004.

Purpose of the collection of personal data of Users

By communicating their personal data, the User accepts their processing by SPOA PROD. This processing aims at establishing traffic statistics for the Site in order to improve its functionality and ensure its maintenance and security.

The recipients of the data

The data processed by SPOA PROD may be viewed by the following persons, among others:

• authorized staff of the marketing department, sales department, customer relationship and prospecting departments, administrative departments, logistics and IT departments and their supervisors;

• authorized personnel of the departments responsible for control (auditor, departments in charge of internal control procedures, etc.);

• authorized personnel of subcontractors

These data remain strictly confidential. SPOA PROD commits not to communicate the User's data to any third party other than those authorized to process the User's personal data, except with the User's express and prior authorization.

User rights on the collected data:

In accordance with the provisions of the French Data Protection Act No. 78-17 of January 6, 1978, the User has the right to access, rectify, oppose, delete, limit processing, and port their personal data.

All requests must be accompanied by proof of identity, bearing the signature of the User and/or their legal representative, and include the information necessary to enable SPOA PROD to respond.
SPOA PROD will do its best to process any complete request as quickly as possible.

ARTICLE 8 – COOKIES

When consulting the Site, cookies are placed on your computer, mobile, or tablet. A cookie is a text file placed when visiting a site or viewing an advertisement. Its purpose is to collect information relating to your browsing and to send you services adapted to your device.
SPOA PROD uses cookies necessary for the functioning of the Site, intended to measure the audience of the Site (number and frequency of visits, number of pages viewed, User activity on the Site) or to improve the interactivity of the Site (share button on social media)

The User can allow, refuse, or disable a cookie. SPOA PROD alerts the User to the fact that total refusal of cookies may make the Site's services inaccessible or result in a less efficient, effective, or less suitable use of the Site.
The management of cookies by the User will depend on the browser used.

ARTICLE 9 - LIMITATIONS OF WARRANTY AND LIABILITY

The Site and its content are provided to the Users as-is and subject to their availability. SPOA PROD cannot be held responsible for any damage, regardless of its nature, resulting from unavailability of the Site, being only subject to an obligation of means.

By using the Site, the User guarantees having the capabilities, equipment, and software suitable for risk-free use of the Site and more generally of the Internet.

SPOA PROD does not guarantee the availability of the Site and/or services, the reliability of transmissions, and performance in terms of response time or quality. No technical assistance for the User is provided, whether by electronic or telephone means. Consequently, SPOA PROD does not guarantee that the Site will be free of anomalies, errors, or bugs, nor that it will function without failure or interruption.

The liability of SPOA PROD cannot be engaged if access to the Site and/or use of the services is impossible.
Moreover, SPOA PROD may discretionarily interrupt the online provision of the Site or any part of the services offered, without notice, all without right to compensation to the User.

The responsibility of SPOA PROD cannot be engaged for damage resulting from the use of the Site and the Internet network such as data loss, computer intrusion, viruses, or other involuntary problems or in the event of force majeure as defined by the case law of the Court of Cassation.

ARTICLE 10 - MISCELLANEOUS PROVISIONS

These GTU are governed by French law. 

In case of a dispute or controversy, the User may file a claim with the Site at the following email address: hello@spoagency.com to seek an amicable solution.

 In the absence of an amicable agreement between the Parties, the dispute will fall under the jurisdiction of the competent courts of Paris.
